Terms and Conditions

    1. All quotations issued by the Company are subject to the availability of hotel accommodations, cruise cabins, related services, and/or flights at the time the reservation is processed. Prices quoted are not guaranteed and may be subject to change without prior notice at the time of booking. 
    2. Itinerary Disclaimer and Right to Amend: All itineraries provided by the Company are sample itineraries, intended solely to offer a general overview of the likely tour schedule. The actual itinerary may vary due to a range of factors including, but not limited to, weather conditions, road conditions, operational constraints, and the physical capabilities of the participants. The Company reserves the absolute right to modify, alter, or amend the itinerary, either prior to the commencement of the tour or while on tour, if such changes are deemed necessary in the interest of the safety, comfort, or general well-being of the Tourists/Group. No claims, refunds, or compensation shall be entertained for any such amendments. 
    3. All services provided by the Company are contingent upon receipt of full payment prior to the scheduled date of departure. In cases where payment is made by cheque, the travel package, tour components, and/or vouchers shall be released only upon successful clearance and realization of the actual amount. 
    4. The Company reserves the right, at any time and for any reason:  a) To cancel any tour package or tour component prior to the date of departure. In such an event, the Company’s liability shall be strictly limited to the refund of all amounts received from the Tourist in respect of the said tour package or tour component. b) To amend, alter, or withdraw any tour, holiday, excursion, or facility previously advertised or published, or to substitute any hotel with another of a similar standard, if deemed necessary or advisable. In such circumstances, the Company shall not be liable for any damages, additional expenses, or consequential losses incurred by the Tourist or the Group. 
    5. No person, other than the Company or its authorized representatives, has the authority, in writing, to vary, amend, amplify, or waive any description, representation, term, or condition set forth herein, in the Company’s brochure, or in any other terms and conditions pertaining to the tour booked by the Tourist with the Company. 
    6. In the event that the Company exercises its right to amend or alter any tour or holiday advertised in its brochure or through any other media after the booking has been confirmed, the Tourist shall have the right to (a) Proceed with the tour or holiday as amended or altered; or (b) Accept an alternative tour or holiday offered by the Company. In either case, the Company shall not be liable for any damages, additional expenses, or consequential losses incurred by the Tourist or the Group as a result of such amendment or alteration. 
    7. The Company shall, under no circumstances whatsoever, be liable to the Tourist or the Group for: a) Any death, personal injury, illness, accident, loss, delay, increased costs, or consequential damages arising from any misadventure or otherwise, howsoever caused; b) Any act, omission, or default of any hotelier, carrier, supplier of travel components, or any other person, or of any employee or agent employed by such suppliers, who may be engaged in or concerned with the provision of accommodation, meals, transport, or other services to the Tourist or Group, howsoever caused. For the purposes of this clause, the term “howsoever caused” shall include negligence on the part of any such person. 
    8. Any liability of the Company arising out of or in connection with this contract, including in respect of any tour, holiday, package, tour component, or excursion, shall in no event exceed the total amount paid or agreed to be paid by the Tourist for the same, and shall in no case extend to cover any consequential damages or additional expenses of any kind. 
    9. The prices quoted by the Company in its brochures or quotations are denominated in Indian Rupees (INR) or the equivalent amount in United States Dollars (USD) or the currency of the destination country, as calculated based on the prevailing exchange rate at the time of quotation. The Company reserves the right to revise and amend these prices at any time prior to departure due to fluctuations in foreign exchange rates, increases in fuel costs, surcharges applicable during Holidays, Special Events, or Peak Seasons, government levies, duties, or any other applicable charges. All such price increases shall be borne and paid in full by the Tourist and shall not be subject to challenge, reduction, or waiver under any circumstances. 
    10. It shall be the sole responsibility of the Tourist or Group to ensure that they possess valid and appropriate travel documents, including but not limited to passports and visas, for the entire duration of the tour. In the event that any such travel document is refused, expires, is delayed, or is cancelled by the issuing authorities, the Tourist shall be solely responsible for all consequences arising therefrom, including any additional costs or expenses incurred as a result. The Company shall bear no liability whatsoever in relation to any such issues concerning travel documentation. 
    11. The grant or refusal of visas is solely at the discretion of the respective Consulate or issuing authority. In the event that a visa is not granted, the Company shall levy the applicable cancellation charges and service fees, and the visa fee shall be non-refundable under all circumstances. Furthermore, in such cases, the Company’s standard cancellation and refund policy shall apply to the entire amount paid by the Tourist towards the tour package. The Tourist shall have no claim for compensation or refund beyond what is expressly provided for in the Company’s cancellation policy. 
    12. The cost of the ticket does not include any insurance premium. Any travel or personal insurance coverage must be obtained by the Tourist or Group separately, at their own expense. 
    13. All tour programs, packages, and tour components are subject to applicable laws, rules, and regulations of the jurisdictions in which they are conducted. The Company shall bear no responsibility or liability for any conditions, disruptions, or consequences arising out of the application or enforcement of such laws, regulations, or due to events constituting force majeure, including but not limited to acts of God, natural calamities, or other unforeseen circumstances beyond the Company’s control. 
    14. Complaints and Claims: Any complaint by the Tourist, including those made on behalf of members of a Group, must be submitted to the Company in writing within seven (7) days from the conclusion of the tour. Under no circumstances shall claims or complaints submitted after this period be entertained. Furthermore, individual complaints from members of a Group shall not be accepted directly by the Company; all such complaints must be submitted exclusively by the Tourist designated as the Group Leader or the individual who made the booking for the tour/travel package. 
    15. Governing Law and Jurisdiction: All claims, disputes, and legal matters arising in connection with tours arranged by the Company shall be governed exclusively by the laws in force in India. The courts of Thiruvananthapuram, Kerala shall have exclusive jurisdiction over any such disputes or litigation. 
    16. Hotel Check-In/Check-Out Policy: Standard international hotel check-in times are between 1400 to 1600 hours, and check-out times are between 1000 to 1200 hours. Should the Tourist or Group arrive before or depart after the designated times, any additional charges levied by the hotel or travel service provider shall be borne solely by the Tourist/Group and settled directly with the respective provider. The Company shall not be liable for such charges. 
    17. Responsibility for Tour Interruptions: The Company shall not be liable for any refund, compensation or claim in the event of reduction in the duration of the tour or cancellation, postponement, or re-routing of any scheduled transportation service due to any reason, including but not limited to adverse weather conditions such as fog. The applicable cancellation and refund policies, as provided at the time of booking, shall govern such situations. Tickets and bookings are subject to the conditions stated herein. 
    18. Purchases and Additional Services: The Company accepts no responsibility for any personal purchases or shopping undertaken by the Tourist during the course of the tour. Furthermore, the Company shall not be held liable for any additional services availed directly by the Tourist from the Company’s vendors, beyond those expressly included in the tour package purchased from the Company. 
    19. Star Classification of Hotels: The classification of hotels (e.g., 5-star, 4-star, etc.) is based on information provided to the Company by the respective hotel or its travel component supplier. While the Company endeavors to verify and present such information in good faith, it does not guarantee the accuracy or correctness of such classifications. The Company shall not be held liable for any misrepresentation or inaccuracy in hotel ratings or descriptions. All descriptions, photographs, sketches, and lists of amenities or facilities are likewise based on data received from third-party suppliers and are provided for illustrative purposes only. 
    20. Baggage Allowance: As a general guideline, passengers are permitted to carry one suitcase not exceeding 20 kilograms and one piece of cabin baggage not exceeding 5 kilograms. However, baggage policies may vary depending on the specific airline, overseas tour operator, or transporter. Typically, one piece of baggage is permitted with linear dimensions (Length + Width + Height) not exceeding 45 inches. Excess baggage may incur additional charges, which are the sole responsibility of the Tourist/Group. The Company shall not be liable for any loss, damage, or delayed delivery of baggage, and any such claims shall be subject to the terms and conditions of the respective airline, tour operator, or hotel. 
    21. Meals: The number of meals, including breakfasts, provided to the Tourist corresponds to the number of nights booked at the hotel. Please note that hotels generally do not serve breakfast on the day of arrival. The Company reserves the right to amend or modify meal arrangements if circumstances so require. Meals are typically pre-set, and individual preferences or menu choices may not be accommodated. 
    22. Transfers: a) Tour Packages: Where transportation is provided on a Seat-in-Coach (SIC) basis, the service is shared with other travelers. b) Sightseeing Tours: Transportation is provided either on a SIC basis or in a private vehicle, depending on the tour package or option selected. c) Airport Transfers: These may be arranged either on a SIC basis or via private vehicle, as per the transfer option booked. 
    23. It is the responsibility of the Tourist to be present at the designated pickup location at the scheduled time for all SIC-based services. Failure to arrive on time will result in forfeiture of the transfer or tour service, and no refund shall be provided. In such cases, the Tourist will be responsible for arranging alternative transportation at their own cost. Delays in SIC services may occur due to traffic conditions or the late arrival of other passengers. Late-night or early-morning transfers may attract an additional surcharge. All coaches operate on fixed routes and schedules and will not deviate from their designated itineraries. 
    24. Currency: The Company advises Tourists/Groups to carry holiday spending money in a combination of currency and traveler’s cheques/credit cards. Arrangements for currency exchange should ideally be made at least one week before departure. Traveler’s cheques are a secure means of carrying funds, as they can be replaced if lost or stolen and are widely accepted for a nominal service fee. The Company shall not be held liable for any loss, theft, or exchange-related issues involving currency or traveler’s cheques. 
    25. Mode of Payment: Payment for the tour/package may be made using any of the following methods: (a) In-Person Payment: The Tourist may visit the Company’s office to make payment directly. (b) Bank Deposit: Payment may be deposited into the Company’s designated HDFC Bank account. Bank account details will be provided by the Company upon request via official communication channels such as telephone, WhatsApp, or email. (c) Digital Payment: Payment may also be made through UPI by scanning the QR code, or via a payment link shared by the Company through its official WhatsApp number, email, or Razorpay link. 
    26. Payment Authorization and Liability: Tourists are strongly advised to ensure that all payments are made exclusively through the official communication channels of the Company and only upon explicit intimation and confirmation from Xplora Getaways Private Limited. The Company shall not, under any circumstances, be held liable for any loss, dispute, or fraudulent transaction arising out of payments made to unauthorized persons, entities, or through unofficial sources. It is the sole responsibility of the Tourist to verify the authenticity of the payment instructions prior to remittance. 
    27. Role of the Company and Limitation of Liability: The Company acts solely in the capacity of a booking agent for overseas tour operators and travel component suppliers, and functions exclusively as a travel agent. The information provided in the Company’s brochures, quotations, or other promotional materials is compiled in good faith and is as accurate as reasonably possible at the time of publication. Descriptions are based on amenities and services normally available; however, such amenities or services may be altered due to circumstances beyond the Company’s control, including but not limited to major roadwork, construction, or natural calamities that may necessitate changes in routes or itineraries. Where such changes are known in advance, the Company will make reasonable efforts to inform the Tourist/Group accordingly. 
    28. The Company does not own, operate, or control any airline, shipping company, coach operator, hotel, transport service, or any other independent entity that provides travel components included in the tour package. As the Company merely coordinates and facilitates bookings for such services, it shall not be liable for any loss, damage, injury, death, deficiency in service, delay, or other inconvenience caused by the act or omission of any third-party provider, including their employees, management, or agents. 
    29. Health Advisory and Physical Fitness Requirements: The travel tour packages and individual tour components offered by the Company often involve substantial physical activity, including but not limited to long periods of walking, standing, and extended travel durations. Certain excursions and activities may include physically demanding experiences such as speed boat rides, balloon rides, and other forms of adventure sports, which are suitable only for individuals who are medically and physically fit. The Company expressly cautions the following categories of individuals from participating in such tours unless medically cleared to do so: a) Individuals with cardiac conditions, b)Pregnant women, c) Senior citizens, d) Persons requiring special assistance or care, e) Individuals suffering from respiratory ailments, arthritis, high or low blood pressure, diabetes, or similar medical conditions. 
    30. The Company does not provide medical support, equipment, or assistance during any part of the tour. Tourists requiring ongoing medical care or support are strongly advised against participating in such tours. All tourists are required to manage their own luggage and personal mobility; no porterage or assistance is included unless explicitly stated. Additionally, some facilities and accommodations may not have elevators/escalators, requiring the use of stairs. 
    31. Any individual who chooses to undertake the tour despite this advisory does so entirely at their own risk and volition. The Company, including its employees, affiliates, and agents, shall not be held liable for any medical condition, complication, injury, or consequence that may arise before, during, or after the tour. 
    32. Tourists are strongly advised to undergo a medical examination and obtain a fitness certificate from a registered medical practitioner prior to booking. 
    33. Health and Travel Insurance: The Company strongly recommends that all Tourists procure comprehensive travel and health insurance prior to departure. Such insurance should ideally cover medical emergencies, personal accidents, trip cancellations, and loss or theft of belongings. The procurement and adequacy of such insurance shall be the sole responsibility of the Tourist. 
    34. Weather Advisory and Limitation of Liability: The Company shall not be liable to any Tourist or Group for any refund, compensation, damages, or claims arising from the shortening, alteration, or curtailment of the tour, or any deviation from the confirmed itinerary, resulting from cancellation, rerouting, postponement, or delay of any airline or other mode of transport due to weather-related conditions, including but not limited to fog, storms, natural calamities, or any other adverse climatic or force majeure events. This also includes any delay or disruption arising from circumstances beyond the reasonable control of the Company. All tickets and travel packages are issued subject to these Terms and Conditions and those of the respective service providers. 
    35. Statutory Price Variations Post-Confirmation: Following the finalization and confirmation of the tour/service cost, any subsequent increase in entrance fees to monuments, museums, or other attractions, as well as revisions in taxes, fuel surcharges, guide charges, or other levies imposed by the Government of India or any competent authority, shall be charged to the Tourist/Group as additional cost. These charges shall be payable in full, and the Tourist/Group shall have no right to dispute or withhold payment of such amounts. 
    36. Limitation of Liability Due to Force Majeure and Other Events Beyond Control: The Company shall not be held liable for any delays, modifications, or alterations to the tour program, or for any expenses incurred—directly or indirectly—due to natural calamities, flight cancellations or delays, accidents, mechanical or equipment failures, transport breakdowns, adverse weather conditions, illness, landslides, political disturbances, or any other unforeseen or untoward incidents. 
    37. Furthermore, the Company shall not be responsible for any loss, injury, damage to person or property, or any other harm arising in connection with accommodations, transportation, or other services resulting—directly or indirectly—from acts of God, fire, accidents, equipment or transport failure, war, civil unrest, strikes, riots, theft, epidemics, quarantines, medical or customs regulations, defaults, or any other causes beyond the control of the Company. 
    38. In all such events, any additional cost or consequence arising shall be solely borne by the Tourist/Group.
